Follow Up: Private Property Rights Forum, April 25th 2011
During the meeting Commissioner Doherty commented about, "...on-site septic systems known to be failing and contributing to nitrates in ground water." The following day, one of the attendees submitted the following public records request: "Under the Public Disclosure Act I am Requesting: All documents identifying the location of the purported known failing or failed on- site septic systems in the Carlsborg UGA, the agency reporting the failures including the results and testing method used in determining the failure/failures and the proof of scientific method. The agency providing the test results, testing method and proof of scientific testing method used in determining the failed or failing on-site septic systems contribution to the nitrate load in the ground water in the Carlsborg UGA."
As of April 30, 2011 following are samples of the responses to his request:
"The Department of Community Development has reviewed our records and determined there are no records in our department to provide. "
"Do we have any documents (e.g., maps, reports) that are Department generated related to septic system failures? "
"The Commissioners' office is not in possession of any records responsive to your request."
A similar request was presented to Clallam County PUD with the following response:
"In response to your latest records request for documents identifying the location of the purported failing or failed onsite septic systems in the Carlsborg UGA, the District is not in possession of documents fitting that description. You may want to check with the County."
